Terms and Conditions

1. Our Role — Connection Services Only

Divergent Wasmeri provides an online platform that allows Family / Hirers / Hirers and Wasmeri / Service providers to find, communicate with, and potentially connect with one another. Account role is chosen at signup and cannot switch between Family / Hirer and Wasmeri / Service provider. Profile role Other can be set later in Settings.

Divergent Wasmeri is a connection platform only.

Divergent Wasmeri does not employ Nannies, Babysitters, Cleaners, Housekeepers, or other service providers listed on the platform.

Divergent Wasmeri does not employ Family / Hirers or act as an employer, employee, recruiter, domestic worker, Wasmeri / Service provider, babysitter, household manager, or personal representative for either party.

Divergent Wasmeri does not become a party to any employment, service, household, caregiving, or other agreement made between a Family / Hirer and a Wasmeri / Service provider.

Any decision to contact, interview, hire, employ, work with, live with, or otherwise engage another user is made entirely by the users involved.

2. Users Are Responsible for Their Own Decisions

Family / Hirers and Nannies are responsible for making their own decisions about who they communicate with, meet, hire, work for, or otherwise engage.

Divergent Wasmeri does not guarantee that a particular Family / Hirer or Wasmeri / Service provider will be suitable for another user.

Users are responsible for conducting their own enquiries, interviews, reference checks, background checks, identity checks, and other checks that they consider appropriate before entering into any arrangement with another user.

Users should take reasonable precautions when communicating with or meeting another person for the first time.

Divergent Wasmeri does not guarantee the identity, qualifications, experience, character, behavior, honesty, reliability, suitability, or conduct of any user.

3. Family / Hirer Responsibilities

Family / Hirers understand and agree that they are responsible for making their own decisions regarding any Wasmeri / Service provider, Babysitter, Cleaner, Housekeeper, Home-Care Worker, or other person they choose to engage through the platform.

Family / Hirers are responsible for determining whether a person is suitable to:

• Care for their children or babies;
• Work inside their home;
• Perform household duties;
• Provide childcare or home-care services;
• Handle household property or belongings; or
• Perform any other duties agreed between the Family / Hirer and the individual.

Divergent Wasmeri is not responsible for the behavior, actions, conduct, negligence, misconduct, dishonesty, theft, abuse, harassment, violence, or other actions of a Wasmeri / Service provider or other individual engaged by a Family / Hirer.

Family / Hirers are responsible for taking whatever additional steps they consider necessary to satisfy themselves that an individual is suitable for their household and circumstances.

Family / Hirers should also ensure that any employment or service arrangement they enter into complies with applicable laws and regulations.

4. Wasmeri / Service provider Responsibilities

Nannies understand and agree that they are responsible for making their own decisions regarding any Family / Hirer they choose to communicate with or work for through the platform.

Nannies should make appropriate enquiries about a Family / Hirer before accepting employment or entering into any arrangement.

Nannies are responsible for considering their own safety and wellbeing when communicating with or meeting Family / Hirers.

Divergent Wasmeri is not responsible for the behavior, actions, conduct, negligence, misconduct, dishonesty, harassment, violence, abuse, exploitation, or other actions of a Family / Hirer or any other person associated with the Family / Hirer.

Nannies should not accept an arrangement if they believe the circumstances are unsafe, unsuitable, unclear, or otherwise unacceptable to them.

5. Employment, Salary and Payment

Divergent Wasmeri does not determine or guarantee the salary, wages, working conditions, benefits, working hours, duties, or other employment terms agreed between a Family / Hirer and a Wasmeri / Service provider.

The Family / Hirer and Wasmeri / Service provider are responsible for discussing and agreeing upon:

• Salary or wages;
• Payment frequency;
• Working hours;
• Duties and responsibilities;
• Days off and leave arrangements;
• Transportation arrangements;
• Accommodation, if applicable;
• Overtime or additional work;
• Trial periods, if applicable;
• Termination arrangements; and
• Any other employment or service conditions.

Divergent Wasmeri is not responsible for whether a Family / Hirer pays a Wasmeri / Service provider, how much the Family / Hirer pays, whether payment is made on time, or whether either party complies with the financial terms of their private agreement.

Any salary or payment amount shown on the platform is information provided by the relevant user and does not constitute a guarantee by Divergent Wasmeri.

Any dispute concerning salary, wages, payment, working conditions, employment, or services must be addressed between the parties involved, subject to any rights or remedies available under applicable law.

6. No Guarantee of Employment or Work

Registering on Divergent Wasmeri does not guarantee that:

• A Wasmeri / Service provider will find employment;
• A Family / Hirer will find a suitable Wasmeri / Service provider;
• A Family / Hirer will hire a particular Wasmeri / Service provider;
• A Wasmeri / Service provider will accept an offer;
• An employment arrangement will continue;
• A particular salary will be offered; or
• A particular number of connections, offers, or opportunities will be received.

Divergent Wasmeri provides access to a platform for connection and communication but does not guarantee an employment outcome.

7. Identity and Document Verification

Divergent Wasmeri may request identification documents from Service Providers who choose optional identity verification. Family / Hirer accounts do not complete identity verification. Email confirmation is still required before using the dashboard.

A listed skill, category or user-written service is information supplied by the user. It is not a qualification, licence or endorsement by Divergent Wasmeri.

Examples may include:

• National Identification Card (NID);
• Passport;
• Driver's licence;
• Other government-issued identification;
• Profile photographs;
• Contact information; or
• Other documents reasonably required for account verification.

Documents submitted for verification are collected for identity confirmation, account verification, fraud prevention, platform security, and related legitimate verification purposes.

Users agree to provide genuine, accurate, current, and legally obtained documents belonging to them.

Users must not upload another person's identification documents without lawful authorization.

8. Use and Protection of Personal Documents

Divergent Wasmeri will not intentionally use identification documents submitted for verification for unrelated purposes.

Personal identification documents are intended to be used for identity and account verification and platform security purposes.

Access to verification information should be limited to authorized persons who require it for legitimate platform-related purposes.

Divergent Wasmeri will take reasonable measures to protect submitted personal information and documents against unauthorized access, misuse, loss, or disclosure.

However, users acknowledge that no online platform or electronic storage system can guarantee absolute security.

Where required by law, Divergent Wasmeri may disclose information to lawful authorities or other authorized parties.

For more information about how personal information is collected, stored, used, and retained, users should refer to the Divergent Wasmeri Privacy Policy.

9. Accuracy of User Information

Users are responsible for ensuring that the information they provide to Divergent Wasmeri is accurate, complete, and not misleading.

Users must not:

• Create an account using another person's identity;
• Provide false identification documents;
• Misrepresent their qualifications or experience;
• Provide false employment information;
• Impersonate another person;
• Misrepresent their intentions; or
• Use the platform for fraudulent or unlawful purposes.

Divergent Wasmeri may suspend or terminate an account if information provided by a user is found to be false, misleading, fraudulent, or otherwise in violation of these Terms.

10. Child Safety

Family / Hirers and Nannies acknowledge that childcare and working around children involves significant responsibility.

Family / Hirers are responsible for carefully selecting and supervising any individual they engage to care for their children.

Nannies are responsible for behaving appropriately and responsibly when caring for children.

Divergent Wasmeri does not provide childcare supervision and does not assume responsibility for the safety of children placed under the care of an individual selected by a Family / Hirer.

Family / Hirers should take appropriate steps to verify a person's suitability before allowing that person to care for their children.

If a user becomes aware of suspected abuse, violence, exploitation, or an immediate safety threat, they should contact the appropriate emergency services or relevant authorities.

11. Personal Safety

Users should use reasonable precautions when communicating with or meeting another person through the platform.

Users are encouraged to:

• Communicate through the platform where appropriate;
• Verify the identity of the person they are dealing with;
• Conduct interviews and reference checks;
• Meet in an appropriate and safe environment when possible;
• Inform a trusted person about meetings;
• Avoid sharing unnecessary sensitive information;
• Never send money to another user unless they independently decide to do so and understand the risks; and
• Leave or discontinue an arrangement if they believe they are in danger or uncomfortable.

Divergent Wasmeri does not guarantee the personal safety of users.

12. User-to-User Communication

Divergent Wasmeri may provide messaging or communication features to allow Family / Hirers and Nannies to communicate.

Users are responsible for the content of their communications and interactions with other users.

Divergent Wasmeri does not assume responsibility for private agreements, promises, statements, representations, or arrangements made between users.

Users must not use the platform to:

• Harass or threaten another person;
• Send abusive or discriminatory messages;
• Commit fraud;
• Request or distribute illegal material;
• Share another person's private information without authorization;
• Misrepresent themselves; or
• Conduct unlawful activities.

13. Offers and Connections

A "Send Offer" feature or similar feature is a platform function that allows a Family / Hirer to express interest in connecting with a Wasmeri / Service provider.

Sending an offer does not create an employment relationship.

Accepting an offer through the platform does not automatically create an employment relationship unless the parties separately agree to an employment or service arrangement.

Users remain responsible for discussing and agreeing upon all terms before beginning work.

14. Platform Fees

Divergent Wasmeri may charge Family / Hirers fees for certain platform features or plans.

Platform fees are fees for access to platform features and connection services. They are not salary, wages, recruitment payments, or payments made to Nannies on behalf of Family / Hirers.

Unless otherwise stated on the platform, paying for a Divergent Wasmeri plan does not guarantee employment, a successful connection, or the hiring of any particular individual.

15. No Guarantee of User Conduct

Divergent Wasmeri may take reasonable measures to operate and moderate the platform, but users acknowledge that the platform may contain information supplied by other users.

Divergent Wasmeri does not guarantee that every user will behave honestly, safely, professionally, or lawfully.

Users remain responsible for conducting their own checks and exercising their own judgment.

16. Reporting Concerns

Users are encouraged to report suspected:

• Fraud;
• Fake identities;
• Fake documents;
• Harassment;
• Abuse;
• Threats;
• Scams;
• Unsafe behavior;
• Misrepresentation; or
• Other serious violations of these Terms

to Divergent Wasmeri through the available reporting or contact channels.

Divergent Wasmeri may review reported conduct and may suspend, restrict, or terminate accounts where appropriate.

Reporting an individual does not guarantee that Divergent Wasmeri will be able to resolve the matter or recover money or other losses.

17. Limitation of Responsibility

To the maximum extent permitted by applicable law, Divergent Wasmeri is not responsible for losses, injuries, damages, disputes, expenses, or other consequences arising from interactions or arrangements between users.

This includes, but is not limited to:

• Personal injury;
• Property damage;
• Theft or loss of property;
• Abuse or misconduct;
• Harassment;
• Violence;
• Fraud;
• Salary or payment disputes;
• Employment disputes;
• Failure to perform agreed duties;
• Poor work performance;
• Breach of an agreement between users;
• Misrepresentation by a user; or
• Actions or omissions of a Family / Hirer, Wasmeri / Service provider, or other person.

Nothing in these Terms is intended to exclude or limit any responsibility that cannot legally be excluded or limited under applicable law.

18. Users' Legal Responsibilities

Family / Hirers and Nannies are responsible for complying with laws applicable to their own activities and arrangements.

Divergent Wasmeri does not provide legal, employment, immigration, tax, financial, childcare, or professional advice through the platform.

Users should obtain appropriate professional advice when necessary.

19. Account Suspension or Termination

Divergent Wasmeri may suspend, restrict, or terminate an account where it reasonably believes that a user:

• Has violated these Terms;
• Has provided false information;
• Has submitted fraudulent documents;
• Has engaged in abusive or threatening behavior;
• Has used the platform for unlawful purposes;
• Has attempted to defraud another user;
• Has compromised platform security; or
• Has otherwise misused the platform.

Divergent Wasmeri may also take reasonable steps to protect users and the integrity of the platform.

20. Changes to These Terms

Divergent Wasmeri may update these Terms and Conditions from time to time.

When significant changes are made, users may be notified through the platform or other reasonable means.

Continued use of the platform after updated Terms become effective constitutes acceptance of the updated Terms, where permitted by applicable law.

21. Acceptance of These Terms

By selecting "I Agree", checking the Terms and Conditions checkbox, creating an account, or using the Divergent Wasmeri platform, you confirm that:

• You have read and understood these Terms and Conditions.
• You understand that Divergent Wasmeri is a connection platform only.
• You understand that Divergent Wasmeri does not employ or directly supervise Nannies or Family / Hirers.
• You understand that you are responsible for your own decision to connect with, communicate with, meet, hire, or work with another user.
• You understand that Divergent Wasmeri does not guarantee the behavior, character, qualifications, safety, honesty, reliability, or suitability of another user.
• You understand that Divergent Wasmeri does not determine or guarantee salary, wages, working conditions, or payment between Family / Hirers and Nannies.
• You understand that Family / Hirers are responsible for deciding whether a Wasmeri / Service provider is suitable to care for their children or work in their home.
• You understand that Nannies are responsible for deciding whether a Family / Hirer is suitable and safe for them to work with.
• You understand that identification documents are collected for identity and account verification and related platform security purposes.
• You agree to provide truthful and accurate information.
• You agree to use the platform lawfully and responsibly.
• You accept responsibility for your own interactions and arrangements with other users.
